Accessory producer Genki is currently facing serious issues with Nintendo’s legal department following the company’s release of concept designs for the Switch 2 just weeks before its initial official trailer was unveiled.
Footage showcasing Genki’s prototype Switch 2 rapidly gained popularity at the CES 2025 exhibition as it was reportedly crafted using the actual console as a reference. Following a visit from Nintendo’s attorneys who reportedly met with the company, Genki responded by arguing that the prototypes were inspired by leaks and they did not “own or have a black market console.”
Nintendo has subsequently initiated legal action against the accessory developer for “infringement, unfair competition, and false advertising,” claiming Genki made “contradictory and inconsistent” statements throughout the complicated situation.
“Starting at least in December 2024, [Genki] launched a calculated campaign aimed at profiting from the public’s interest in Nintendo’s forthcoming console,” the brand known for Mario stated in new US court documents.
“In January 2025, [Genki] began promoting that it had obtained unauthorized access to Nintendo’s upcoming Nintendo Switch 2 console, which had not yet been launched or disclosed to the public by Nintendo,” it further explained. “After initially claiming access to a genuine Nintendo Switch 2 unit, Defendant’s statements became contradictory and inconsistent, with the Defendant later claiming it never had possession of such a console. Yet, the Defendant has consistently maintained its assertion to consumers that its accessories will be compatible with the Nintendo Switch 2 upon the console’s launch.”
Nintendo argues that Genki’s assertions regarding compatibility “could not be verified” unless it had “illegally or illegitimately acquired an authentic Nintendo Switch 2” or technical data about the console well before it was made public. Hence, Nintendo contends that the company either deceived consumers to take advantage of the Switch 2 buzz or had unauthorized access to the forthcoming console.
“Genki’s claims of compatibility would be impossible to confirm without unlawful, illegal early access to the Nintendo Switch 2. Thus, Genki has misled and continues to mislead the public regarding its ability to ensure the compatibility of its products with the Nintendo Switch 2.”
