Dutch Consumer Foundation Takes Legal Action Against Sony Over Digital PlayStation Game Pricing

The Dutch consumer organization Massaschade & Consument has initiated a collective legal action against Sony regarding the pricing of digital PlayStation games in the region.

According to a report translated from Tweakers, the organization claims that digital PlayStation games in the Netherlands are priced 47 percent higher than their physical versions, despite having lower distribution costs in the area. In 2019, Sony ceased permitting third-party retailers to sell codes for digital games, meaning that the only way to buy a digital PlayStation 4 or 5 title is with physical currency or by purchasing specifically priced cards at brick-and-mortar stores.

“The Japanese corporation exploits its leading position in the console marketplace,” stated Massaschade. “For years, millions of Dutch individuals have been overpaying for PlayStation games and in-game items. […] This monopoly on digital sales, combined with PlayStation’s substantial market share in the console industry, contributes to what is termed a ‘Sony tax.'”

Massaschade mentioned that its lawsuit was filed on behalf of “over three million Dutch PlayStation enthusiasts,” urging Sony to “cease its misconduct and reimburse the excess tax charged.”

Sony has frequently faced criticism for its purported monopoly over its digital marketplace. U.S. gamers previously sued the corporation in 2021 without success. A consumer rights advocate in the UK also filed a separate lawsuit in 2023. Massaschade’s statement referenced the UK case, asserting that Sony’s practices “breach Dutch and European competition regulations.”

Foundation chairperson Lucia Melcherts further asserted that Sony pressures developers to “accept the terms that Sony enforces on them, including the prices at which their games are offered. […] PlayStation users keep paying premium prices, even for titles that are several years old.”

“Sony is the sole vendor that can make choices without concern for competitors, developers, or customers,” Melcherts added. “This trend is detrimental, and PlayStation owners will increasingly notice the effects in their wallets. While a company like Sony can be profitable, consumers deserve equitable pricing.”

Massaschade encouraged Dutch gamers affected by Sony’s purported conduct to join its Elegant PlayStation initiative. The initial court hearing is expected to take place later in 2025.
